These Terms of Service ("Terms") govern your access to and use of The Trip Binder application and related services ("Service"), operated by Wondernook Studios LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Description of service
The Trip Binder is a trip management platform for K–12 school field trips. It allows school organizers to create trips, manage student rosters, assign chaperones and bus/hotel groups, track attendance, and communicate with parents. Guardians can link to their child's record, review trip details, and share selected student information with authorized school organizers.
2. Eligibility
Organizers and guardians must be at least 18 years old to create an account. Students may use the Service directly as travelers only if they are at least 13 years old. The Trip Binder is not directed to children under 13, and we do not knowingly permit anyone under 13 to create an account or join a trip, even with parental permission. Younger students do not use the Service directly; their information is managed by school organizers and linked guardians.
3. Account responsibilities
You are responsible for:
- Providing accurate information when creating your account
- Keeping your login credentials confidential
- All activity that occurs under your account
- Notifying us immediately if you suspect unauthorized access to your account
4. Organizer responsibilities and FERPA
If you use the Service as a school organizer, you represent and warrant that:
- You are authorized by your school to handle and share the student data you upload
- Your use of student records complies with FERPA and any applicable state student privacy laws
- You have obtained, or your school has obtained, any required parental consents
- You will not import records for any student over whom you do not have legitimate educational authority
- You will promptly notify us of any unauthorized disclosure of student data
We act as a service provider processing student education records on your behalf. We do not control the content you upload and are not responsible for ensuring your compliance with FERPA or your institution's data governance policies.
5. Guardian responsibilities
If you use the Service as a guardian:
- You represent that you are the parent or legal guardian of the student(s) whose records you claim or manage
- You are responsible for the accuracy of information you add or edit
- You understand that information you share with an organization is accessible to that organization's authorized organizers and assigned chaperones
6. Acceptable use
You agree not to:
- Import or submit student data that you are not authorized to share
- Use the Service to harass, threaten, or harm any individual
- Post, upload, send, or share content that is abusive, harassing, hateful, defamatory, sexually explicit, violent, or otherwise objectionable
- Use chat features to send spam or content unrelated to trip management
- Attempt to access another user's account or any record you are not authorized to view
- Reverse engineer, decompile, or attempt to extract source code from the app
- Use automated scripts or bots to access the Service
- Upload files containing malware or content that violates applicable law
Zero tolerance for objectionable content and abusive users. We do not tolerate objectionable content or abusive behavior in chat or any user-generated content. The app lets you report any message and block any user. We review reports within 24 hours and will remove content that violates these Terms and may suspend or permanently remove users who post it. 7. Student health and medical data
The Service is designed to store health-relevant information about students for the purpose of student safety during trips. This information is not used for medical diagnosis or treatment. Organizers and chaperones who access student health information agree to use it only for the student's safety and well-being during the trip and to treat it with the same confidentiality as any other education record.
8. Content you provide
You retain ownership of content you upload to the Service, including student records, documents, photos, and chat messages. By uploading content, you grant us a limited, non-exclusive license to store, display, and transmit that content solely as necessary to provide the Service.
9. Privacy
Our Privacy Policy describes how we collect, use, and protect your information and student data and is incorporated into these Terms.
10. Intellectual property
The Trip Binder application — including its design, code, branding, and non-user content — is owned by Wondernook Studios LLC and protected by copyright, trademark, and other intellectual property laws.
11. Service availability
We make reasonable efforts to keep the Service available and reliable, but we do not guarantee uninterrupted access. If we discontinue the Service entirely, we will provide at least 30 days' notice so you can export your data.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
The Trip Binder is a trip management tool. It is not a safety monitoring system, an emergency response service, or a substitute for adequate adult supervision. Trip organizers and chaperones remain solely responsible for the safety and supervision of students in their care.
13. Limitation of liability
To the fullest extent permitted by applicable law, Wondernook Studios LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
Our total liability to you for any claim shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.
14. Indemnification
You agree to indemnify, defend, and hold harmless Wondernook Studios LLC and its officers, employees, and agents from and against any claims, damages, losses, and expenses arising from your violation of these Terms, applicable law (including FERPA/COPPA), content you submit, or your negligence or willful misconduct.
15. Termination
You may stop using the Service and delete your account at any time from the Account screen. We may suspend or terminate your access if you violate these Terms, if required by law, or if your account poses a security risk.
16. Subscriptions and payments
The Trip Binder offers optional paid features through the Apple App Store, including a one-time "Trip Pass" and an auto-renewing "Organizer Plus" subscription.
- Payment is charged to your Apple ID account when you confirm the purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- You can manage your subscription and turn off auto-renewal in your App Store account settings.
- Current pricing is shown in the app before you purchase. If a subscription price changes, we will notify you as required by the App Store.
- Purchases and refunds are processed by Apple under the Apple Media Services Terms and Conditions. We generally do not provide refunds directly; refund requests are handled by Apple.
17. Apple App Store
The following applies when you obtain the app through the Apple App Store:
- These Terms are between you and Wondernook Studios LLC only, not Apple, and Apple is not responsible for the app or its content.
- Your license to use the app is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the app.
- To the maximum extent permitted by law, Apple has no warranty obligation for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims relating to the app, including product-liability, legal, regulatory, or consumer-protection claims, or any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a U.S.-embargoed country and are not on any U.S. government restricted-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Governing law and dispute resolution
These Terms are governed by the laws of the State of Pennsylvania. Any dispute shall be resolved exclusively in the state or federal courts located in Pennsylvania. Before filing any legal claim, you agree to contact us at contact@thetripbinder.com and give us 30 days to attempt to resolve the dispute informally.
19. Changes to these terms
We may update these Terms to reflect changes in the Service or applicable law. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
